‘Delays in Implementation of Amnesty Can Damage Colombia Peace Process’: FARC Head Counsel Enrique Santiago (S)

FARC legal advisor, Spanish lawyer Enrique Santiago, claims that the judges are in breach of the Amnesty Law and warns that the Attorney General’s Office seeks to neuter the Special Jurisdiction for Peace (Jurisdicción Especial de Paz). In an interview withe Semana, Mr. Santiago warned that “The prosecutor should not act as if the process of talks were open.”

Regarding the effects of the delays in the implementation of the Amnesty Law, Mr Santiago said to Semana.Without application of the amnesty and without the release of those members or collaborators of FARC entitled to Amnesty under the Final Agreement, it is irresponsible to pretend to demand that weapons be laid down. FARC are showing a commitment to the peace process which is more explicit and effective than that expressed by several state institutions. I imagine that both the Office of the Attorney General and the courts are aware that the non-application of the amnesty causes great discomfort among the guerrilla prisoners and between the guerrilla rank and file. This generates mistrust because it calls into question the will to comply with the State, and, therefore, encourages dissent within the FARC. In my opinion, there are sectors interested in making the peace agreement fail this way.” Semana
